Persuasive Essay On The First Amendment - 875 Words

The first amendment is like using sunscreen for your skin. Without it your right for freedom of religion, speech, press, assembly, and petition wouldn’t be protected, just like your skin wouldn’t be protected from all of the harmful UV rays from the sun. This amendment was written in the Bill of Rights in 1791. The Bill of Rights is a document of the first ten amendments which were written in order to limit control of the government, and give more rights to the people. This amendment protects these rights, giving us a nation without a national religion, and a country which cannot abridge the freedom of speech, disobey the freedom of press, and restrict our rights to assemble and petition. Although these rights are guaranteed to be protected, there have been cases where there were problems re garding the freedoms guaranteed in the First Amendment. One landmark case is the Tinker v. Des Moines Community School District, where three students were suspended for wearing black armbands to protest the Vietnam War in a public school. The school created a policy forbidding armbands after hearing about their plan to wear them, which the students wore anyways. The school suspended the three students for violating the school policy. They later sued the district for violating the 1st Amendment of the freedom of expression. The district court dismissed the case because the school was judicious to sustain the school policy. The U.S. Court of Appeals for the Eighth Circuit affirmed the decision. To this day, there are cases still going on regarding the First Amendment. One of the contemporary cases is the Reed v. Town of Gilbert, Ariz.
